Supplemental Terms for the Wyze Cam

These Supplemental Terms for the Smart Vision Skill (these “Smart Vision Terms”) are in addition to, and not in lieu of, your rights and obligations under the Wyze Terms of Service (the “Standard Terms”) and the Supplemental Terms for The Wyze Cam (“Wyze Cam Terms”).  The Smart Vision Skill works in conjunction with a designated Wyze camera.  Any supplemental terms that apply to the designated Wyze camera you use in creating your Smart Vision Skill also applies, which could include the Supplemental Terms for Cam Plus Services,  the Supplemental Terms for Cam Plus Pro Services, and/or the Supplemental Terms for Home Monitoring Service (the “Supplemental Wyze Camera Terms”).  In case of a conflict between the Wyze Cam Terms, the Supplemental Wyze Camera Terms, and these Smart Vision Terms, these Smart Vision Terms shall control.

The Smart Vision Skill is only available in the United States and only available on certain Wyze devices.  Wyze may also modify or amend these Smart Vision Terms in its sole discretion without advance notice by posting the modified or amended Smart Vision Terms on the Site or through the Wyze App (and/or by email notification if we so choose). Material changes to these Smart Vision Terms will be posted in a prominent place or manner. Please check our site or the Wyze App to see any updates or changes made to these Smart Vision Terms. All modified terms and conditions will be effective after they are posted, unless a longer notice period is required by applicable law or unless we indicate in our posting or email notifications to you (if applicable) a specified effective date. If any modified terms and conditions are not acceptable to you, your sole remedy is to cease using the Smart Vision Skill, and, if applicable, cancel your Account. IF YOU DO NOT AGREE WITH ANY OF THE CHANGES TO ANY OF THESE SMART VISION TERMS, YOU SHOULD CEASE ACCESSING OR USING THE SMART VISION SKILL. By continuing to access or use the Smart Vision Skill after Wyze posts any such revision to these Smart Vision Terms, you agree to be bound by the updated or modified Smart Vision Terms. These Smart Vision Terms may not otherwise be modified or amended, except with the written agreement of both parties.

PRIVACY

For information about how we collect, use, share and otherwise process information, please see our Privacy Statement. Before using the Smart Vision Skill, it is your obligation to determine whether your intended use is subject to any data protection or privacy laws, and to comply with such laws at all times. For example, you may want to notify and/or obtain the consent of any individuals who appear in still images you submit to create your Skill.  Where people appear in still images used to create a Skill, the Smart Vision Skill does not identify those people, but rather recognizes people in the still image as one of several objects in the still image.  The Smart Vision Skill is intended for purely personal and household use. These Smart Vision Terms do not permit you to use the Smart Vision Skill in a business or a workplace.

SMART VISION SKILL

The Smart Vision Skill allows you to enable a designated Wyze camera to recognize a video image that is similar to a set of like still images you upload and name (the “Smart Vision Skill”).  For example, if you upload a set of still images from your designated Wyze camera of a closed door and name those collective images “door closed,” the Smart Vision Skill allows that designated Wyze camera to recognize and inform you in subsequent video recordings if it recognizes a similar “door closed” image (each named Smart Vision Skill is a “Skill”).  The Smart Vision Skill is generally specific to the designated Wyze camera on which you create it.  So, another Wyze camera in your home will not be able to recognize a closed door in another room that does not match the still images from the designated Wyze camera you used to create your Skill.    

LICENSE TO USE

Subject to these Smart Vision Terms, Wyze grants you a limited, non-transferable, non-exclusive right to access and use the Smart Vision Skill to create Skills to use in conjunction with your designated Wyze device for personal and household use only.  You have no ownership rights in any Skills you create, and Wyze retains all intellectual property rights to Skills created through Smart Vision, including any improvements to models and algorithms, and can use, create derivative works from, and license Skills as permitted by applicable law. 

USE OF CONTENT

Wyze does not claim any ownership of the intellectual property rights associated with User Recordings or the still images submitted to create Skills and will only use User Recordings and the still images as outlined in our Privacy Statement.

PERMITTED USE

In connection with your use of the Smart Vision Skill, you may only: (a) upload still images from your designated Wyze camera; and (b) upload still images for which you have all necessary rights, consents, and permissions to upload.

RIGHT TO REJECT OR DELETE ANY SKILLS

Wyze may, but does not have the obligation to, reject or delete any Skills, and all associated still images or information therewith, that it deems in its sole discretion to be inappropriate or harmful or for any other basis or no basis at all.

YOU ACKNOWLEDGE THE SMART VISION SKILL MAY CONTAIN BUGS, ERRORS AND DEFECTS. ACCORDINGLY, THE SMART VISION SKILL IS PROVIDED "AS IS," WITH ALL FAULTS, DEFECTS AND ERRORS, AND WITHOUT WARRANTY OF ANY KIND. WYZE DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED AND ARISING BY LAW OR OTHERWISE) REGARDING THE SMART VISION SKILL AND ITS PERFORMANCE OR SUITABILITY FOR YOUR INTENDED USE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WYZE HAS NO LIABILITY OF ANY KIND FOR THE USE OF OR INABILITY TO USE THE SMART VISION SKILL OR FOR ANY LOSS OF DATA.
