Supplemental Terms for Descriptive Alert Feature

The Wyze Descriptive Alert feature ("Descriptive Alert") is only available in conjunction with certain Cam Plus subscriptions (the "Cam Plus Service"). These Supplemental Terms for the Descriptive Alert Feature (the "Descriptive Alert Terms") are in addition to, and not in lieu of, your rights and obligations under the Wyze Terms of Service (the "Standard Terms") and, as applicable, the Supplemental Terms for Cam Plus and Cam Unlimited Service ("Cam Plus and Cam Unlimited Terms").

Wyze may modify or amend these Descriptive Alert Terms in its sole discretion without advance notice by posting the modified or amended Descriptive Alert on the Site or through the Wyze App (and/or by email notification if we so choose). Material changes to these Descriptive Alert Terms will be posted in a prominent place or manner. Please check our site or the Wyze App to see any updates or changes made to these Descriptive Alert Terms. All modified terms and conditions will be effective after they are posted, unless a longer notice period is required by applicable law or unless we indicate in our posting or email notifications to you (if applicable) a specified effective date. If any modified terms and conditions are not acceptable to you, your sole remedy is to cease using Descriptive Alert, and, if applicable, cancel your Account. IF YOU DO NOT AGREE WITH ANY OF THE CHANGES TO ANY OF THESE DESCRIPTIVE ALERT TERMS, YOU SHOULD CEASE ACCESSING OR USING THE DESCRIPTIVE ALERT SERVICES. By continuing to access or use the Descriptive Alert Services after Wyze posts any such revision to these Descriptive Alert Terms, you agree to be bound by the updated or modified Descriptive Alert Terms. These Descriptive Alert Terms may not otherwise be modified or amended, except with the written agreement of both parties.

1. ELIGIBILITY

You must have a current qualifying Cam Plus Service in order to enable Descriptive Alert.

2. PRIVACY; USE OF GENERATIVE AI

When you enable Descriptive Alert, you understand and acknowledge that Descriptive Alert uses generative artificial intelligence ("GenAI") to process and analyze the videos from your Wyze camera to create descriptions of the activity or actions in those videos (the "Descriptions"). In so doing, Descriptive Alert may collect images of people in your videos and derive information and draw inferences from those images in order to describe the activity in your videos. Except to the extent set forth in Section 4 below, Descriptive Alert does not use the images to identify or try to identify any particular person but will generate Descriptions to generically describe a person in the video (e.g. man, woman, child, delivery person, etc.). 3. DELETION AND RETENTION OF DESCRIPTIONS

We retain the Descriptions for fourteen (14) days after the original recording. You can access those Descriptions through your account or download them onto a device. After the initial fourteen (14) days, we automatically delete the Descriptions, unless we believe retention of those Descriptions for a longer period is required by applicable law or legal process. You can delete the Descriptions and videos from your account at any time. If you delete the video, the corresponding Descriptions will automatically be deleted within 14 days of the original video recording date. If you terminate Descriptive Alert or the Cam Plus Service, we will delete the Descriptions within 14 days of termination.

4. FOR FRIENDLY FACES SUBSCRIBERS

If you are a Friendly Faces subscriber who has that feature enabled on the camera with Descriptive Alert, you understand and agree that Descriptive Alert may use the identified name of the person from the Friendly Faces feature to generate Descriptions of the activity in your video. The Supplemental Terms for Friendly Faces govern your use of the Friendly Faces feature.

5. PROHIBITED USES; CONSENT

You may only use  Descriptive Alert for personal or household purposes. You may not use Descriptive Alert in any commercial, work, or public settings or in any manner that might be deemed threatening, harassing, inappropriate, illegal, or in violation of a reasonable expectation of privacy. You should not enable Descriptive Alert with a camera that may collect images that are private or sensitive (e.g. bathroom). You consent to Descriptive Alert generating Descriptions from your Wyze camera relating to anyone in your household or anyone who is an invitee on your property for use in accordance with these Descriptive Alert Terms or as separately agreed to or consented by you.

6. WYZE DISCLAIMER; NO WARRANTY OF ACCURACY

The Descriptions can be inaccurate and contain errors. Descriptive Alert relies on GenAI, which is an evolving technology that is limited by, among other things, the data used to train it. Descriptive Alert does not always make correct inferences and may sometimes guess at Descriptions if it cannot otherwise determine how to describe the activity. You will use Descriptive Alert for your convenience only and should not rely on it for accuracy or as a substitute for your own human review. Wyze makes no representations or warranties regarding the accuracy or reliability of Descriptive Alert or the Descriptions. You may delete inaccurate Descriptions through your account and may report inaccuracies with Descriptions by submitting it as Feedback as described in our Standard Terms.

7. TERMINATION

You may terminate Descriptive Alert at any time by turning off this feature in your Wyze account. To do so, you will need to navigate to the "Account" setting in the Wyze App, select "Wyze Intelligence,"  and then toggle off " Descriptive Alert."
